By accessing or using the Sparkle server, you agree to comply with and be bound by the following Terms of Service. Please read these terms carefully before creating an account or accessing the service.

Important

Minors must obtain the consent of a parent or legal guardian prior to using the Sparkle server.

Article 1: Acceptance of Terms

By creating an account or accessing the Sparkle server, you acknowledge that you have read, understood, and agreed to be bound by these Terms of Service.

Article 2: Account Registration

  • Access to the Sparkle server requires an account.
  • Users may create multiple accounts, provided the total number remains fewer than 10 accounts per individual.

Article 3: Device Management & User Responsibility

  • You are solely responsible for managing your device, credentials, and account information.
  • You accept full responsibility for all activities that occur under your account.
  • Server operators are not liable for any loss or issues caused by account mismanagement, shared device usage, or third-party unauthorized access.

Article 4: Handling of Game Data

  • Users do not hold ownership or intellectual property rights over in-game data, accounts, or application binaries.
  • Server operators reserve the right to modify, delete, or reset account data if these terms are violated or for technical maintenance.

Article 5: Intellectual Property Rights

  • All copyrights, trademarks, and intellectual property rights related to the official game client, characters, and assets belong strictly to their respective rightsholders and developers.
  • Sparkle is an unofficial fan community project and does not claim ownership over official game content.

Article 6: In-Game Currency

  • All in-game currency on the Sparkle server is provided 100% free of charge; there are no paid purchase options or real-money microtransactions.
  • In-game currency has no expiration date and may only be used to acquire items or services within the server.
  • Currency exchange, transfers, or real-money trading (RMT) with other individuals outside intended game mechanics are strictly prohibited.

Article 7: User Expenses & Recommendations

  • Users are responsible for all device, hardware, and telecommunication expenses required to access the server.
  • As a token of support for the original franchise, users are encouraged to purchase at least one official Manga Time Kirara publication per year.

Article 8: Data Collection & Privacy

  • Technical information (such as device metrics and usage logs) may be collected during gameplay to ensure service reliability and server optimization.
  • Collected information will be handled appropriately in accordance with standard privacy practices and used for operations and notifications.
  • Data will not be shared with third parties except when required by legal authorities.

Article 9: Advertisements & Third-Party Links

  • The game or affiliated web pages may display external links or advertisements.
  • Server maintainers make no guarantees regarding the safety, accuracy, or quality of external linked content and accept no responsibility for damages incurred from third-party sites.

Article 10: Disclaimer of Warranties

  • Sparkle servers are provided "AS IS" and "AS AVAILABLE" without warranties of any kind.
  • Operators do not guarantee that the server will be uninterrupted, error-free, or immune to security vulnerabilities.
  • Operators accept no liability for damages resulting from unauthorized access, server outages, computer viruses, or user-to-user disputes.

Article 11: Account Suspension & Termination

Server operators reserve the right to restrict, suspend, or delete user accounts without prior notice if: 1. You violate any provision of these Terms of Service. 2. Server operations or technical stability are compromised. 3. Any other significant condition warrants intervention as determined by maintainers.

Article 12: Service Modifications & Discontinuance

  • Game content and server features may be altered, suspended, or permanently terminated at any time.
  • Temporary downtime may occur due to maintenance, system upgrades, or unforeseen disruptions.
  • Operators are not liable for damages or inconvenience resulting from service changes or downtime.

Article 13: Prohibited Actions

The following actions are strictly forbidden on the Sparkle server: - Violating laws, regulations, or community standards. - Submitting false details or misusing another individual's personal information. - Commercializing in-game data or engaging in real-money trading (RMT). - Interfering with normal server operations, deploying exploits, or disrupting gameplay. - Deceiving, impersonating, or defrauding other users.

Warning

Engaging in prohibited activities will result in immediate and permanent account suspension.

Article 14: Compensation for Damages

If a user causes damage or disruption to the server due to intentional misconduct or violation of these terms, the user agrees to sincerely apologize to the maintainers 100 times.

Article 15: Non-Transferability

Users may not assign, transfer, sell, or pledge their account status, rights, or obligations to any third party.

Article 16: Revision of Terms

  • Maintainers reserve the right to revise these Terms of Service at any time with prior notification where feasible.
  • Continued use of the server following any revision constitutes full agreement to the updated terms.

Article 17: Governing Law & Jurisdiction

  • These Terms of Service shall be governed by and construed in accordance with the laws of Etoilia.
  • Any legal dispute arising out of or in connection with the Sparkle server shall be subject to the exclusive jurisdiction of the Etoilia District Court.
